AI Policy Overview
Florida lawmakers have enacted a handful of AI-related laws. Also in 2024, lawmakers enacted a law (FL SB 1680) creating the Florida Government Technology Modernization Council to study and monitor the development and deployment of AI systems and also makes it unlawful to possess or control computer-generated child pornography. That year, Florida lawmakers also enacted a law (FL HB 1361) providing for the award of grants to school districts to implement artificial intelligence in support of students and teachers.
Deepfakes
In 2024, Florida enacted a political deepfake law (FL HB 919) that requires political advertising to include a disclaimer if it uses generative AI that appears to depict a real person performing an action that did not occur in reality and was created with the intent to injure a candidate or to deceive regarding a ballot issue. The law provides for civil and criminal penalties.
In 2024, Florida enacted a sexual deepfake law (FL SB 1680), which makes it unlawful to possess or control computer-generated child pornography.
