AI Policy Overview

Georgia lawmakers have yet to prioritize artificial intelligence policies broadly. However, Georgia was quick to take action with regard to sexual deepfakes, and in 2021 enacted a law making it a felony to knowingly transmit a sexually explicit deepfake image or video without the consent of the depicted person and enacted another law in 2024 regarding deepfakes depicting minors.

Deepfakes

Georgia enacted a law (GA SB 78) in 2021 making it a felony to knowingly transmit, without the consent of the depicted person, "a photograph  or video which depicts nudity or sexually explicit conduct of an adult, including a falsely created videographic or still image, when the transmission or post is harassment or causes financial loss to the depicted person, and serves no legitimate purpose to the depicted  person." 

In 2024, Georgia enacted a law (GA HB 993) clarifying that it is not a defense from prosecution of sexual exploitation of children that the visual medium was created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.
