AI Policy Overview
Kentucky lawmakers have taken action to prioritize artificial intelligence policies. In the summer of 2023, the Interim Joint Committee on Tourism, Small Business, and Information Technology held a meeting with a briefing on the landscape of AI. At the meeting, some lawmakers expressed concerns about potential bias and the impact it would have on jobs.
In 2024 and 2025, lawmakers enacted laws addressing sexual and political deepfakes.
In 2025, Kentucky enacted a law (KY SB 4) to establish standards for government use of AI, require disclosures, and create an AI governance committee. This law directs the Commonwealth Office of Technology to establish policy standards for the ethical use of generative and high-risk AI systems and creates an Artificial Intelligence Governance Committee. Additionally, the law requires state agencies to disclose when AI is used to render a decision regarding citizens, in any process or to produce materials to inform a decision, or to produce information accessible by citizens and businesses and requires agencies to submit a review of third-party AI developers, system administrators, and contractors to mitigate the risk of data breaches. Under the law, state agencies must have a risk management policy and impact assessment for high-risk AI systems making a consequential decision.
Deepfakes
In 2024, Kentucky enacted a sexual deepfakes law (KY HB 207) that adds computer-generated images of a minor person to child pornography provisions. In 2025, as part of a broader AI law (KY SB 4), Kentucky enacted restrictions on political deepfakes, allowing political candidates to seek injunctive or other equitable relief against political deepfake communications without a clear and conspicuous disclaimer.
