AI Policy Overview
Maryland lawmakers have yet to prioritize artificial intelligence policies broadly. However, in the summer of 2023, lawmakers discussed issues surrounding artificial intelligence and machine learning in a hearing by the Joint Committee on Cybersecurity, Information Technology and Biotechnology. The committee also discussed AI in a November 2023 meeting.
Under a 2024 law (MD SB 818) state agencies are required to conduct certain inventories and assessments on AI systems. The law also requires higher education institutions to establish policies on AI and prohibits procurement of an AI system that does not adhere to certain policies. Finally, the law established a Governor's Artificial Intelligence Subcabinet.
Employment
In 2020, Maryland enacted a law (MD HB 1202) prohibiting an employer from using certain facial recognition services during an applicant's interview for employment unless the applicant consents. Notably, the law does not contain an explicit cause of action to enforce violations.
Facial Recognition
In 2024, Maryland enacted a law (MD SB 182), which establishes requirements, procedures, and prohibitions relating to the use of facial recognition technology by a law enforcement agency. The law also preempts some local regulations on facial recognition.
