AI Policy Overview

Oregon lawmakers were one of the first states to adopt artificial intelligence policies when in 2015 they enacted a law prohibiting police from using facial recognition to analyze images captured by body cameras. In 2024, lawmakers enacted a political deepfake bill into law.

In 2023, Governor Tina Kotek (D) issued an executive order establishing an advisory council that will guide the role of artificial intelligence in state government. The council will provide a recommended action plan framework no later than six months from the date of its first convening and a final recommended action plan no later than 12 months from its first convening.

In 2024, lawmakers enacted a bill (OR HB 4153) into law that establishes a Task Force on AI tasked with examining and identifying terms and definitions related to AI that may be used for legislation.

Facial Recognition

In 2015, lawmakers in Oregon enacted a bill (OR HB 2571) prohibiting police from using facial recognition or any other biometric matching technology to analyze recordings obtained through police body cameras.

Deepfakes

In 2024, Oregon enacted a law (OR SB 1571) to require a campaign communication that includes any form of synthetic media to include a disclosure stating that the image, audio recording, or video recording has been manipulated. The law allows state officials to enjoin violators of the law and may seek civil penalties of up to $10,000.  Content carriers and broadcasters are exempt from the law.
